TERMS & CONDITIONS OF NUBELUS UG (HAFTUNGSBESCHRÄNKT)

With a binding booking for an European Collaboration Summit event, I accept the Terms and Conditions of Nubelus UG (haftungsbeschränkt), An der Römervilla 8, 55411 Bingen am Rhein (subsequently: Organizer). The booking for sponsors/partners and/or delegates (subsequently jointly: customer) is binding. The booking first generates an automatic access confirmation. Upon receipt of the booking, the customer will receive a confirmation of attendance with regard to the booking of the event as long as the event is still available. The contract is concluded by the booking confirmation. These Terms & Conditions are valid for the booking of the event of the Organizer and are subject to other agreements. The right to participate in the events acquired with the conclusion of the contract is not transferable.

(1) SPONSORS AND PARTNERS

BOOKING, PAYMENT, AND DEFAULT OF PAYMENT

In case that a sponsor/partner participates, the contract/booking between the Organizer and the sponsor/partner begins with the confirmation of booking by the Organizer. The respective services and compensatory payments are regulated in a separate sponsorship/partnership agreement, to which these General Terms and Conditions are attached. The respective amount, as agreed in the sponsorship or partnership agreement, is due for payment once the sponsor/partner receives the invoice, if not stated otherwise in a written form. The sponsor/partner is not permitted to participate in the event if full payment has not been received by the Organizer. In case of a default of payment, the Organizer reserves the right towards the sponsor/partner to prohibit access to the event, cancel the contract, and/or release the contracted elements and/or exhibit space to other sponsors/partners.

Only registered participants of the sponsor/partner will receive their personal full conference pass or floor conference pass (giving access to the event) at the conference check-in at the venue. It is a prerequisite for the handing-over of the conference pass (giving access to the event) that the conference booking fee is paid into the Organizer’s account by the time of the start of the conference.

LIABILITY AND CANCELLATION

Cancellation by the business partner or sponsor must be made in written form sent to: Nubelus UG haftungsbeschränkt, An der Römervilla 8, 55411 Bingen am Rhein, info@nubelus.de.

The business partner or sponsor shall have the right to terminate the contract free of charge during a period of five days after the confirmation of the booking by the Organizer.

The sponsor or partner shall have the right to terminate the contract in writing no later than six months (180 days) before the event start date. In this case, the sponsor or partner will be charged 50 percent of the contracted fee (VAT included) by the Organizer. Any cancellation by the sponsor/partner after the above mentioned deadline of six months (180 days) will be charged by the Organizer with 100 percent of the contracted fee.
The Organizer reserves the right to revoke the participation confirmation unilaterally and to cancel or postpone the conference. In this case, you can participate in the new or other date / seminar or cancel the booking. In the latter case, the fee paid will be reimbursed. Further claims are excluded. The same applies to all other services of the Organizer. The

Organizer reserves the right to change the content or timing of the event, or to replace individual speakers in the form of comparable alternatives. There is no legal claim to the management of the booked event by the speakers mentioned on this website. The representative of the said lecturer by another lecturer of the Organizer for a given occasion, for example, illness or other reasons for disqualification remains the same. The same applies to all other services of the Organizer.

The Organizer is not liable for damages due to technical malfunctions that may occur as a result of higher power in particular fluctuations or power cuts.

The Organizer bears no responsibility for changes need to the event due to force majure. This includes in particular: armed conflict, civil unrest, terrorist threats, natural disasters, political constraints, significant influence on transport.

MARKETING MATERIAL

Marketing material to go into attendees’ bags must be provided to the sponsor/partner between 5 and 10 working days before the event takes place. If material does not arrive in time at the address provided in advance, the Organizer cannot guarantee that your material will be included in the bags. The Organizer assumes no liability for possible damages caused by delay of delivery.

(2) DELEGATES

BOOKING, PAYMENT, AND DEFAULT OF PAYMENT

In case that a delegate participates, the contract/booking between the Organizer and the delegate begins with confirmation of the booking by the Organizer. The booking shall contain: delegate’s first and last names, job title, company name, function, and contact details.

The respective amount is due for payment once the delegate receives the invoice. The delegate is not permitted to participate in the event if full payment has not been received by the Organizer.

All registered delegates will receive their personal conference pass (giving access to the event) at the conference check-in at the venue. It is a prerequisite for the handing-over of the conference pass (giving access to the event) that the conference booking fee is paid into the Organizer’s account by the time of the start of the conference.

WITHDRAWAL, LIABILITY AND CANCELLATION

Any customer who is a Consumer shall be entitled to revoke the offer in accordance with the cancellation and return policy as separately made available to the Customer on our website during the ordering process.

Cancellation by a delegate must be made in written form sent to: Nubelus UG (haftungsbeschränkt), An der Römervilla 8, 55411 Bingen am Rhein, info@nubelus.de.

For a cancellation made ten or more weeks before the event date, the Organizer will charge 50% of the registration fee as a cancellation fee. After that date, or in the event of a no-show, the Organizer will charge 100% of the registration fee.

The assignment of a substitute in a similar position is possible, in agreement and consultation with the Organizer.

(3) PRIVACY, COPYRIGHT AND TRANSFER BAN

The personal data of our customers is stored and processed according to §§ 23-25 BDSG. Delegates who do not agree to this should contact the Organizer in writing immediately.

By signing the registration, the delegate agrees to the photo, video and audio recordings to be made at the event for promotional purposes. The photo, video and audio material is in the sole ownership of the Organizer.

The delegate confirms agreement to his or her personnel data being stored in the database of the Organizer. This data is used solely within the contractually agreed services with the Organizer.

The Organizer reserves all copyright and other intellectual property rights relating to the event name, event brochure, event program, and all other event documentation.

(4) DATA PROTECTION

The analysis and use of delegate data is for event-specific purposes only. Data is used for the purposes of billing, statistics, distribution, marketing, and research of new topics only. Data is not used for any other purposes and there is no disclosure to unauthorized third parties.

By registering for the event, the delegate gives consent to be sent information by fax, post, phone and/or email for the marketing purposes of the Organizer and its partners and event sponsors. This consent may be objected to in writing.

The Organizer collects, stores and processes information in order to better understand its customers and to continually improve its services. By using the services of the Organizer, each customer agrees to the collection and the use of “personal data” as described in this Privacy Policy.

Each customer can at any time, free of charge, without explanation or reason, wholly or partially sending a note in written or textform to Nubelus UG (haftungsbeschränkt), An der Römervilla 8, 55411 Bingen am Rhein, info@nubelus.de in order to:

  • object to the collection and use of their “personal data”;
  • revoke consent for collection and use of their “personal data”;
  • request information on how their “personal data” has been collected or used by the Organizer;
  • correct or amend “personal data” stored by the Organizer;
  • request closure of records and deletion of “personal data” stored by the Organizer;

All data collected by Organizer is stored exclusively to support the transmission of product information and/or the submission of service offers.

The Organizer ensures that your personal data is treated confidentially, in accordance with data protection regulations. The Organizer assures you that it does not pass personal data to unauthorized third parties, unless we are legally obligated to do so, or explicit prior consent has been given.

(5) FINAL PROVISIONS

The laws of the Federal Republic of Germany shall apply to contracts between the offerer and the customer, excluding the United Nations Convention on Contracts for the International Sale of Goods. The statutory provisions restricting the choice of law and the applicability of mandatory regulations, in particular the state in which the consumer as a consumer is habitually resident, remain unaffected.

If the customer is a merchant, a legal entity under public law or a public-law special fund, the court of jurisdiction for all disputes arising from contractual relationships between the customer and the provider is the place of business of the provider.

The contract shall remain binding in the remaining parts of the contract even if individual points are legally invalid. Instead of the ineffective points, the statutory regulations occur, if available. To the extent that this would represent an unreasonable hardship for a contractual party, the contract becomes ineffective in its entirety.
